LD3 held an election for a new Chairman and Board on 12-1-22 per the statutory election guidelines and bylaws.
THIS WAS NEVER AN EFFORT TO REMOVE THE CHAIR IT WAS ABOUT AN ELECTION CHALLENGE THAT RESULTED IN A NEW ELECTION.
Peace Proposal
•Keep division one reports to AZGOP the other reports to MCRC
•Next election run by MCRC and AZGOP
•Money in treasury given to Czarnys group
•Each group has their own bylaws
•No oversight over one another
•Meetings not to be the same night so people can attend both
•Delegate meeting for selection or presidential candidate to be done at the same time
•50% of delegates come from each group•Nominees to appear on ballot for one or the other side
•NO PC removals are to be done
•Candace gets full PC rights without restrictions
•No SC vacancies to be filled until 2-1-24
•One SC name will be different on SC list not named in peace documents at this time
•$1000 from AZGOP will be given to each LD once signed

•Chairman JD & Member at Large MH suggested this should be done without taking it to the Body•
•Chairman DeWit agreed to sign the MAL Hamilton proposed agreement•
•DeWit offered $1,000 to each LD if signed•

•It was suggested that they would arrange a meeting via phone•
•I was called by Chair DeWit and MAL Hamilton 2 times during the holidays – about 2 hours total•
•I did not contact Czarny as was suggested because that would have potential legal consequences violating Statutes•

•They suggested doing this agreement outside of the body. I made it clear I would not comply with that request

•Several statutes listed are likely violated in this proposal based on legal council•
•Bylaws are not followed in this proposal•
•Chairman Berland will not agree to potentially violating bylaws & statutes•
•I have no authority to override the decision of the MCRC-EGC related to Czarny•
•Czarny increased her propaganda while this truce/proposal was presented so she likely will never follow it anyway•
•This proposal totally ignores the facts of what transpired from 12-1-23 in LD3 election as this was not a move to remove the chair as per the bylaws, it was a challenge of a statutory election per the bylaws.
Excerpt from the letter given to Hamilton & DeWit by Chairman Gomez
While Chairman Berland and I both come from a corporate background where compromise
and settlement agreements between parties are commonly used when the parties are in a legal
position to do so. However, in the situation at hand, we believe that our duty, as elected
chairs of a private political organization, is a position of service to the body as a whole and
not as the final decision maker on behalf of the body. Because of this, we both feel compelled
to present any dealings of this nature directly to the body we serve. In saying that, as the
state, county and legislative districts are formed under A.R.S. as is redistricting (as this
proposal entertains), we again must look at the authority who creates these decisions.
Each of the following Arizona Revised Statues, including 16-821, 16-824, 16-825, 16-825.01
all make reference to the county committee and/or county precinct committeeman with 16-
821 stating: The whole number of precinct committeemen of a political party shall constitute
the county committee of the party. A.R.S. 16-824 states: The chairman of the county
committee shall be ex officio a member of the state committee.
The State committee is referenced in A.R.S. 16-825: The state committee of each party shall
consist, in addition to the chairman of the several county committees, of one member of the
county committee for every three members of the county committee elected pursuant to section
16-821. Additionally, A.R.S. 16-825.01 further states: All members must be a member of
their county committee. And in A.R.S. 16-825.01 B. In the event of a vacancy… vacancy
shall be filled by appointment made by the state chairman with the advice and consent of the
county chairman of the county in which the vacancy occurred.
Although argued that A.R.S. 16-823, A. justifies the AZGOP has some sort of authority over
the county parties, there is no validity to this effect as it specifically states: A political party
entitled to representation on the ballot pursuant to section 16-801 (new party) or 16-
804 (votes cast) may establish a district party committee for any legislative district as
prescribed by law. Additionally A.R.S. 16-822, E. states: … Additional duties shall be as
provided for in the state committee bylaws of the precinct committeeman's political
party. This only makes reference to elected state committeeman and not to all PCs.
Again,not all PCs are members of the state party nor may they attend the AZGOP yearly meeting.
Chairman Berland and I both believe that signing off on this proposal will bring even more
division if not put before the LD3 body.
UPDATE: Presented to the Body of LD3 at the January 2024 meeting - no vote taken due to the potential legal issues regarding statutes.
AZGOP will kick in enough to sweeten the deal to $4,000+
The response to the offer letter makes me look bad.
The only way this deal works is if we are silent on at and then just roll it out. Don't take it to the body.

December 17, 2022 Deadline of candidate commitment to run for office
January 3-5, 2023 Jeff Dewit resigns as C.E.O., but retains position on the board.
January 20, 2023 Jeff Dewit states that he did resign as C.E.O. and has already
negotiated with free use of Superfeed for the AZGOP IF he is elected as Chair.
The only three people that will be representing Arizona at the national level (RNC) are the AZGOP Chair, National Committeeman and National Committeewoman.
All three are on the Board of Directors for Superfeed. Sounds very interesting.
Superfeed apps were built for Turning Point’s AmericaFest, Kari Lake’s Governor Campaign, Jim Lamon’s Senate Campaign and Kelly Cooper’s House Campaign (Mr. Cooper tells us that although the app was purchased, he is not aware if his campaign use it). The donation of the service and date to Kari Lake was NOT disclosed as a campaign contribution in violation of campaign contribution guidelines.
